Why Do We Have Tint Laws?
The one-word answer is safety. Without clear regulations, many car owners might overdo the tint, reducing their ability to see the road at night or low-light conditions. The safety angle is also important from a law enforcement point of view. Darker tints prevent them from seeing inside a vehicle during traffic stops or emergencies.
So, while tinting is allowed by law, the tint can’t interfere with visibility or obscure the vehicle’s interior too much. Ontario’s Highway Traffic Act covers this under section 73, which prohibits coatings or tints that “substantially obscure” the inside of a car.
Automotive Window Tint Basics: What You Can and Can’t Tint
The rules aren’t complicated, provided you understand the properties of various types of car window films.
Window
The first is that your front windshield cannot have any aftermarket tint across it. The only exception is a 3-inch thick “sun strip” along the top of the windshield that helps reduce glare from sunlight.
Front Side Windows
When it comes to your front windows, they must allow at least 70% of visible light to pass through. What that means is a very light window tint is acceptable. Opt for something slightly darker, and it can easily cross into illegal territory. Simply put, you could be fined if an officer can’t see into your vehicle clearly.
Rear Windows
The rules loosen up a lot for the rear side windows and the rear windshield. You can go as dark as you want on those, as long as your vehicle has both left and right-side mirrors. That ensures you can still see behind you safely, even if the rear glass is tinted.
An important rule to remember is to avoid mirrored or reflective tints.
Drivers who are sensitive to sunlight for medical reasons can apply for an exemption through the Ministry of Transportation, but those cases are rare and require documentation.
What Happens If You Ignore the Rules
You might think, “It’s only a window tint. How tough can it be?”. When you’re caught, it can get expensive and inconvenient pretty quickly. Fine range from $85 up to $500. If your car fails its safety inspection because of your tint, it means you won’t be able to legally sell, re-register, or transfer ownership until the tint is removed.
You may also receive a “remove tint” order from law enforcement which means shelling out for professional tint removal services before your car is allowed back on the road.
An illegal tint can also complicate insurance claims, especially if visibility issues contribute to an accident.
